(七)关于基本生活费是否适用仲裁时效的问题 依照《山东省企业工资支付规定》第31条的规定,非因劳动者原因造成企业停工、停产、歇业时,劳动者可以要求用人单据支付基本生活费。基本生活费并非是劳动者付出劳动的对价,而是用人单据依法承担的一种社会责任。同时,在司法实践也存在着用人单据与劳动者长期“两不找”,时隔多年以后劳动者要求用人单据支付几年甚至十几年的基本生活费的案件,若对这类案件中劳动者的主张全部支持,不符合社会公平原则。而且这种案件中的企业大多经营状况很差,濒临破产边缘,若对于劳动者的主张全部支持,尤其是一些群体性案件,则很可能使这些企业难以为继,不符合既要保障劳动者合法权益,又要维护用人单据生存发展的审判原则。因此,劳动者请求用人单据支付基本生活费的在劳动争议调解仲裁法实施之前,适用《劳动法》第82条规定的仲裁申请期限,劳动争议调解仲裁法实施之后,应适用该法规定的仲裁时效。
